Throughout the country, many over-the-counter drugs have become a household word. People take them without a second thought. Likewise, patients trust their doctors to prescribe medications that are safe for them to take. In most cases, drugs and medications may be safe to take. However, an increasing number of pharmaceutical products are proving to put people at risk, resulting in unhealthy side effects, and in some cases, even death. Bextra, Celebrex, and Vioxx, to name a few, are drugs that have harmed people and become the subject of scrutiny and lawsuits.

Pharmaceutical companies have been guilty of putting drugs on the market that have been inadequately tested or lack clear instructions or ample warnings. Approximately 17,000 product liability cases were filed against multi-national drug companies in 2005. Public awareness is beginning to heighten, and the litany of possible drug side effects announced on television as required promotion for drug advertisement are a sign of the changing times.

At Davis, Bethune & Jones, we represented a cancer patient in a lawsuit brought against drug companies and a pharmacist who diluted chemotherapy drugs. The case resulted in a $2.2 billion recovery for woman who had been given the diluted chemotherapy medication. The drug companies had kept accurate records of drug sales and distribution and when the pharmacist’s figures didn’t make sense, they were negligent in reporting or doing anything about it.
